[33] CONCLUSION
1. INTRODUCTION
As we
all knew that India is known for moderately cheap labour and extremely
hardworking, dedicated, result oriented, committed and talent workforce. It is
mainly due to the honesty and sincerity of workforce in the work (other than
some of the government workforce) belonging mostly to the BPL, Low income group
and middle income group engaged in the work mainly to earn their bread/ roti,
but very sadly even after India being emerged as one of the super power nation
with rapid industrialisation, urbanisation and economic growth, still larger portion
of the workforce is in unorganised sector / informal sector as government
employment is very small portion of the total workforce , while the private
business establishments and industries are adopting the method of more contract
employees and a nominal / small percentage of regular employees thus creating
more unorganised workforce/ informal workforce in organised sector as well
apart from the totally informal / unorganised sector of business/household
(with less than 10 employees). As the informal sector is occupying over 93% of
the total workforce (in organised and unorganised sector) of which agriculture
sector alone are near about 53% of the workforce and rest is distributed to
various sectors; again the analysis of distribution of informal sector as per
the National statistical survey report 2012 on unorganised sector reveals that

As per the survey carried out by the
National Sample Survey Organization in the year 1999-2000, the total employment
in both organized and unorganized sector in the country was of the order of
39.7 Crore i.e. around 2.8 Crore in the organized sector and the balance 36.9
Crore (about 93%) in the unorganized sector. Out of 36.9 Crore workers in the
unorganized sector, there are 23.7Crore workers employed in agricultural
sector, about 1.7 Crore in construction work, 4.1 Crore in manufacturing, 3.7
Crore in trade and 3.7 Crore in transport, communication and services. Also the
contribution of un organised sector to the GDP is almost half of the organised
sector and the gross value addition by the informal sector is over 53% compared
to organised sector contribution
Also
the labour of the innocent people are being exploited by majority of the non-government
employers either individuals (households for domestic help or kirana shop
proprietors their helpers) or business establishments/ corporate making them to
work like “cogs in oil mills” to extract more work
output with less pay (in spite of existence of minimum wages act –as the
implementation is very poor due to lack of adequate awareness and also manpower
in the labour departments of the government coupled with no stringent
punishments in this regard) and un-ergonomic work conditions and only motto of the
employers is to earn profit, more profit to become rich, richer and richest
& wealthiest by making small organisations/establishments to big industrial
giants in the shortest duration possible; Also very sadly due to the rise of
neo feudalism in the parliamentary democracy most of the feudalistic mentality leaders
(from gram panchayat to parliament) are in association with the capitalists are
running big business empires and ensuring the laws favour them in one or other
manner protecting the interests of the capitalists rather than workforce and
common people. It starts from the force able acquisition of fertile land with
high market value for dead cheap by the government in the interest of private
capitalists with the pretext of providing the jobs of unorganised workers, semi
skilled labour and paying a vary nominal compensation which will be of very
less use making the lives of millions of people throughout the country in
misery literally curbing the lively hood of the farmers and other section of
people dependent on natural resources like fishing etc; also this is leading to
reduction of agriculture production, and also most of the projects once
announced some of the local leaders and other real estate capitalists are
acquiring the nearby lands and selling it to the other ancillary industries and
cheating land owners by acquiring at nominal price and selling it exorbitantly
high prices and making wind fall profits in the transactions.
Since
most of the establishments have one common thing that is the nexus with the
strong political leaders (cutting across party lines) and capitalists
irrespective of ruling governments in states / local the law makers and law
implementers extend undue favours to these capitalist in covering the
violations of the existing laws (many intellectuals feel that some of them are
tailor made to suit some of the organisations) to ensure speedy process of the
project construction to speedy break even to more profits quickly as if there
is no tomorrow. In the process some of the places found gross violation of environment laws in effluents discharge,
pollutant gaseous emissions, gross violation of issue of water, conversion of
land use causing great damage to the cultivation due to pollution caused by
these kind of industries, also causing great health hazards/deterioration of
health in the vicinity of habitations etc;
Also in
the urge of quicker project completion most of the experienced and trained
manpower from the government companies being poached by the so called giant
corporates luring the well trained individuals with handsome pay packages and naturally well
trained PSU and government employees and other private organisation employees
who are getting relatively low pay compared to corporate giants will join the
new company and work more dedicatedly to ensure the project is completed well
in advance then the projected projected completion time being sincere in their
heart. But to their shock after few
months the so called industrial giants who are fully feudalistic, captilist
mentality mercilessly drastically reduce the pay to the lowest minimum far
below than few years back they are getting in the PSU/ government organisation
and making them to work with that lower pay since there is no much use for them
their services once the project is completed (literally treating the trained
workforce as “polished call grils”) and making the lives of these kind of workforce
literally in hell as by seeing the high pay they are taken loans for more
comfortable house, big cars etc and the lower
present pay not even sufficient for the maintenance of household needs forgetting about the
repayment of various loans; Most of such lacks of people are undergoing the
acute mental stress due to financial crunch due the deceiving tactics/
exploitation tactics of the employers of industrial giants and business
establishments, these deceived employees are helpless to fight with the
managements as they are with money power and political nexus and remain as
living dead for rest of their life. Also it is a fact very hard to accept but
truth is truth, since the acute financial crunch making the downsized employees
after the projects are completed who used to more comfortable life enjoying
high social through their proper planning for rest of their life with the
presumption of the pay getting, once they are denied such payments and getting
mere peanuts some of the employers are becoming perverted and are indulging in wrong
activities to earn extra income to balance their monthly income, in some cases due
to extreme pressures for repayment of loans from banks and other financial
institutions (as it is evident most of the private sector banks using the goons
to recover the dues) some of their female family members are entering the flush
trade through hi-fy prostitution rackets running in the cities to earn extra money to pay their loans(the
advertisements in the news papers “body massage, enjoyment & relaxation by
decent high class females, house wives etc” is the live example? It is a common
sense why house wives will go public to do body massage for some xyz unknown male
strangers in hotel rooms and homes??????), very sad, very sad these capitalists
are ruining the life of millions of people and even are the cause for
indirect flush trade to some extent in
the urban areas??????
Coming
to the case of farmers since the fertile lands or even normal lands are being
extorted by the capitalists using their political nexus and bureaucratic nexus
and their money power and muscle power by paying peanut compensation for the
land owners and farmers, but strangely the same land was being pledged in the
banks and financial institutions and getting loans to establish the industries
and also for the working capital for running the industry????; after few years
(two to three years) once farmers who are living with satisfaction to some
extent in their life to having two meals a day (in spite of exploitation by the
business people from seeds to fertilizers to pesticides to agriculture produce
purchase in the market yards) now becoming merely agriculture labour and are
becoming the MNREGA card holders seeking the alams from the governments, where
as the factories / industries established in their land are becoming multi
billionaires and are entering the billionaires club in the country. How strange
is this?????; also this kind of promotion of industrialisation is one of the
reason for reduction of agriculture output effecting the entire country????
Also this is the cause of rise of naxlisim in the rural areas.
Also
it is a fact since most of the services received by the most of the industries
are in contract labour the labour are literally at the disposal of the
managements, since the contract labour cannot form unions to demand justice for
them, the managements are acting according to their whims and fancies
exploiting the workforce to the maximum extent possible. (Also the urban areas
since there is no associations/ unions / regulators for the unorganised sector
employees like domestic help, kirans shop helpers, drivers, security guards,
helpers in the super markets, real estate agents etc) Also it is fact that some
of union leaders behaviour are very questionable, and once become union leader
or members in the trade unions they feel they are unquestionable free paid
employees and enjoy the life by some sort of extortion/ undue favours obtained
from different vested interests in creating the issues and start black mailing
the managements to extort some money for their luxury (in some cases as small
as alcohol or other pleasure comforts leaving their married wife in greave
misery) in the name of rights of the workers pretending to the workers they are
working for the welfare of the workers but in reality they are working for
their self centred interests. Also some of the unions are hand in glove with
the managements being political connections and the unions are won in the
elections at the indirect support of all kinds from the management itself to
manage workers properly and are pampered by the managements to exploit the
workforce, as such in spite of existence of unions in majority of the
factories/ industries are exploiting the work force.
Also
coming the very common unorganised workforce is domestic help, the drivers, washer
men, cobbler, sweepers, the plumbers, the electricians, the mechanics,
watchmen, security guards etc are hardly has a uniform pay/ pay as per their hardship and hardly
their welfare has been taken care by their employers.
Also
it is a fact that due to rapid urbanisation by 2030 the urban population will
be around 40 % of the total population and by 2050 the urban population more
than 55 % of the total population need for streamlining of workforce is very
much necessary as the economy needed to be streamlined in order to create the
infrastructure to bare that population load by the cities, which needs rapid
rise in the revenues of the state without effecting the life of the people.
Also
it is a fact that most of the people in the urge of accumulation of wealth they
save every penny , since the expenditure on rent, repayment of loans for
housing ( as per statistics that over 85% population has housing but the urban
housing only 65% and that too only few sections has more number of houses and
also migrations due to employment, other reasons necessities the need for urban
housing), other statutory payments like the electricity bills (which are on the
rise year after year in most parts of
the country), water bill, mobile bills,
other taxes, they are left with
only option to save more is by controlling the expenditure on food and
adjusting with whatever available or just to fill the stomach without proper
care for balanced nutrient diet which
requires them to spend considerable amount, in doing so not only they are
spoiling their own health (as if balanced nutrient food intake is good naturally
they are healthy), if people are healthy then naturally the productivity will
be more and naturally economy is on the rise, which naturally ensures better
living standards. Also need to inculcate in the minds of the people that state
alone is the sole responsible for everything by doing everything fee to them
(as most of the political parties in some states by completion offering
everything free to the people as election promises- if the same trend continues
some people may expect and some political parties may do also that “you look
for the would be spouse we will marry” then other political parties may come
with scheme that we not only perform marriage but our party workers produce
children free without much efforts of the married couple- of course through
IVF), as such it should be the responsibility of every individual to contribute
themselves at least part of their earnings towards certain activities, also it
is equal responsibility of the employers / business organisations what they are
because of the employees, as such the welfare of the employees is there primary
responsibility, All these circumstances
leads to the very necessary to bring systemic changes to bring the unorganised
sector workforce to organised sector work force to ensure curtailing of
exploitation of millions of workforce by the employers either an individual or
a corporate giant organisation, in a WIN-WIN manner for both the workforce as
well as employers.
2. NEED FOR MANDATORY
REGISTRATION OF PROFESSION WISE WORKFORCE IN EVERY CATEGORY; NEED FOR ISSUE OF
PROFESSIONAL ID CARDS FOR ALL KINDS OF PROFESSIONALS; MANDATORY FOR EMPLOYERS
TO EMPLOY ONLY REGISTERED WORKFORCE, FAILURE SHOULD LEAD TO CRIMINAL OFFENCE.
The
government must enact law making it mandatory that all kinds of professional
service providers should mandatorily get registered in the government; for this
the government must incorporate a unified department with profession wise cells
to register to obtain the ID card by submitting the details of the personal
information about family, stay etc along with voter ID card by all the citizens
and a bio metric fingerprint; for this government can also utilise the post
offices/banks to register the profession wise member card, the card should be
unique number as per the profession. (pre activated cards should be provided to
the post offices, banks , RTA offices, labour department offices etc which can
issue card by taking the details from the individuals in the standard format
and the bio metric details of the individual, on uploading the details
individuals in the computer system, the bar code details integrated will
recognize the no duplication elsewhere through online verification of databank
from the central server as the issue centres are conned through the internet to
the central databank- on verification of uniqueness of data of fingerprint will
issue the card) The card should have both unique number and bar-code in the
front and magnetic strip/ electronic strip in the back to be used for manual
entry, bar code reader as well as swipe card. This card has multipurpose multi
dimensional usages. First it provides the data of profession wise people in the
country; also it provides number of people who are skilled/ semi skilled/ un
skilled, the training needed for the semi skilled or un skilled; also caste
wise professionals etc; also it enables
the payments made were accurate and as per the government decided minimum wages
per professional services subjected to other conditions; this method will
certainly prevents the exploitation of labour work force (as every payment to
the worker for any service rendered should be through the referring of the ID
card number, which will enable them to adhere to the minimum wages as was
determined from time to time); also it provides means for providing health care
for each individual professional and their immediate family; also this enables
all the payments made in cash for the professional services are recorded by the
contractors/ employers and it provides clear claim of real expenditure for the labour
payments. Also these methods reduce the child labour. It should be made
mandatory that all employers should employ only registered workforce, failure
should lead to heavy penalty and should be made a non bail able criminal
offence.
3. NEED FOR SETTING UP
OF SKILL DEVELOPMENT TRAINING INSTITUTES FOR PROVIDING TRAINING PROFESSION WISE
, ALSO FOR UP GRADING THE SKILLS FOR THE EXISTING WORKFORCE IN EVERY
DISTRICT IN ALMOST ALL THE STATES.
Also it should be
made made mandatory that there should be skill development and training
institutes in every district in appropriate number with skill development and
up grading the latest techniques in performing the skills etc, the institutes
should be a joint collaboration of state government and the industry associations
and the central government for conducting various skill development & up
gradation programmes free of cost for all the people who wish to do so, in case
of certain professions like drivers, electricians, plumbers etc in case found
their present skills are not sufficient to provide registration to enable them
be in the profession chosen they should mandatorily undergo the skill
development programme, and once they learned they should be registered in that
professional workforce. Also the
services like tour guides, the real estate agents etc should be thought about
the history and the legal terminology related to property etc should be thought
respectively as per their chosen profession. Also for other professions based
on the profession should conduct the mass training camps. This will certainly
improve the efficiency in work also reduces the accidents betterment for both
employee and the employer.
4. NEED FOR FIXING
UNIFORM PAY FOR SAME KIND OF PROFESSIONALS DECIDED BASED ON THE LOCAL
CONDITIONS AND ALSO MORE PAY BASED ON EXPERIENCE FOR CERTAIN PROFESSIONAL
SERVICES; NEED FOR STANDARDISATION OF WORK ENVIRONMENT
Also
it should be ideal to make profession wise minimum payments per day / per
working hour depending up on the type of service; the pay determined should be
uniform through pout the country with little variation of addition of maximum
of 20% depending up on the local conditions for labour workforce of similar
nature (for domestic help, drivers, kirana shop/ supermarket helpers, helpers
at different commercial outlets/shops, washer men, cobblers, sweepers, labour
force at agriculture, quarrying, hamali, hotel servers/helpers etc, the
clerical jobs, the semi skilled /trained workmen like copy machine operators,
DTP operators, electricians, plumbers, carpenters, gold smith, black
smith, various sales persons from
marketing products to policies, tour guides, etc etc); also the professional
services of same kind should have equal pay minimum (for engineers staff of
different nature like construction engineers, software engineers etc, HR
people, front office people, accounts people etc) by all the organisations
throughout the country; also it should be ideal to make almost same working
standards exist in all the offices and work places both executive as well as
workforce in all organisations of same nature with slight modifications
depending up on the regional conditions of weather, and the office working
conditions and the turnover of the organisation.
5. NEED FOR CONDUCTING
MASS WORKSHOPS AND PROPAGANDA FOR PROFESSION
WISE (FOR ALL UN ORGANISED EMPLOYEES) IN EVERY WARD/ MANDAL/ DISTRICT
REGARDING THE OCCUPATIONAL DISEASES AND TO OVER COME THEM, THE GENERAL HEALTH
CARE OF THE FAMILY ETC
Also it should be
made mandatory that the labour department in association with the industrial
associations and other professional associations should conduct the mass
workshops/ awareness programmes for occupational diseases and personal &
family health care in almost all the professions
from ward/ mandal/ district and at the industrial clusters and areas
periodically in a planned manner in association with the health department,
revenue department, the labour department, the industries department and the
industrial associations calling the expert doctors for guidance and check-up,
also the nutritional experts to guide them the nutritional food which they can
afford at their cost of living (low cost nutritional food) etc to ensure
protective health care measures preventing the possible health disorders rather
than post health care after the disorder. These measures will certainly enhance
health of the employee as well their family, which will lead to better work
output , betterment of both employer as well as employee.
6. NEED FOR BANNING OF
POLITICAL PARTY BASED/BACKED UNIONS IN ALL TRADE UNIONS AT WORK PLACE POLITICAL
PARTY SYSTEM DIVISION SHOULD NOT OCCUR; NEED FOR COMPLETE BAN OF INDIVIDUAL
INDUSTRY/ BUSINESS ORGANISATION WISE UNIONS
Also
it should be most ideal to ensure that all workforces should be allowed to form
unions and these unions should be barred from having linkages and tie-up’s with
political parties, every individual can have like for some political party
ideologies as per their personal wish; all workers who wish to contest for
election as a union member should be barred from holding primary membership of
any political party; only professional workers welfare organisation unions
should be allowed to form unions in the wards/villages/ mandal/ division/
district / state and nation. The body of the organisation should be elected
from within the members of that organisation of that particular profession in
those regional boundaries. And complete ban of workers unions in individual
organisations/workplace (with few exceptions), only organisations with more
than 100 employees of the same level can form sub unions in that particular organisation
regarding that particular workforce only but they should act only under the
direction of district association of the same professional services workforce
organisation.
7. NEED FOR FIXING THE
TENURE OF THE OFFICE BEARERS OF THE UNIONS TO A MAXIMUM OF TWO TERMS WITH
FIXING THE TENURE OF THE UNION TWO YEARS
Also
it should be made mandatory that the tenure of the office bearers as well the
number of office bearers and also number of terms one individual can act as
office bearer of the union should be fixed; the ideal tenure for any union
should be two years and maximum terms an individual can be in the union
executive should be two terms (four years in their working life time) and the
number of executives in the union should be less than 10 members at the
village/ward and also at the mandal level for each village/mandal, whereas at
the district level it should be limited to double the number of mandals in the
district, and at state level two member from each district and at the national level two members from
each state with few more additional members from states with larger population.
8. NEED FOR MAKING ALL
THE MEMBERS MANDATORILY VOTE IN THE ELECTIONS WHICH EVER PART THEY ARE, AND
FAILURE TO EXTEND VOTE SHOULD BE LIABLE TO EXPEL FROM THE UNION.- ONLY PERSONS
WHO GOT 50% MAJORITY AS UNION LEADERS.
Also
it should be made mandatory that all the members of the association in the
particular workforce should directly vote and elect the panel at that level
till the mandal level; and from district level, state level and national level
all the office bearers of the elected at the mandal / block should elect the
body in an indirect election method. The unions should be eligible to be recognised
only when they secure more than 50 % of the voters, all the registered members
at the mandal level; and 50% of the union office bearers for the district,
state and national level unions. In case no one gets this majority in the first
incidence then the top two should be re voted to get absolute majority.
9. NEED FOR
INSTALLATION OF CC CAMERAS AND BIO METRIC DEVICES AT WORK PLACE IN ALL THE
GOVERNMENT AND PRIVATE ESTABLISHMENTS- UNION LEADERS BUST HAVE 75% PRESENT IN
THE WORK PLACE TO SET EXAMPLE FOR OTHER WORKER (CERTAINLY REMOVE THE IDEA OF
FREE BIRDS AND DO ANYTHING UNDER THE COVER OF THE UNION)
Also
it should be made mandatory that CC cameras should be installed at all the work
places in all organisations with more than 10 employees. Also bio-metric system
of attendance should be introduced in all work places (including the onsite
temporary jobs like construction/ repair activities of any nature like roads,
buildings, mechanical, municipal, agriculture labour, quarry labour, hamali etc
etc) and ensure the presence of the workforce in time and out the work place in
time and maintain the rest periods as was designed in the workplace following
the ILO suggestions for reduction of stress and fatigue in the workforce for
more work output as well as better health of the workforce. Also this method
will ensure the union office bearers will too work, as it is a common trend
that most of the union office bearers and leaders never perform their duty with
dedication but take their pay, which is a common syndrome in most of the
government and PSU and in some of the private organisations. The installation
of CC cameras at the work place will certainly create more responsibility and
deliver better work output both in the shop floor as well as in offices. Also
this method ensures reduction of corruption activities in the government
offices. Also it should be made mandatory to keep mobile safes at the entrance
of the work place to ensure all the employees deposit the mobiles at the mobile
safe during the working hours and in case of emergency calls the employees can
make and receive calls from the land phones provided in the office. Also it
should be ideal to provide intercom to almost all the employees within the
reach of two meters or at their desk with more number of lines per number of
the organisation. Or one office mobile phone per organisation for texting with
contact number for any message to a particular employee in case of medical
emergencies to be received and passed by the management. These methods are WIN-WIN methods for both the employees as
well as the management of the organisation as these methods will create a
conductive work atmosphere and the best work output will be delivered.
10.
NEED FOR MINIMUM ATTENDANCE OF 66 % TO THE DUTY AND
PERFORMANCE AT THE WORK SHOULD BE REQUIRED TO BE CONTINUED AS UNION LEADER EVEN
AFTER ELECTION; THE ATTENDANCE SHOULD BE REVIEWED QUARTERLY; ALSO OVER ALL
ATTENDANCE OF OVER 75 % REQUIRED TO CONTEST ELECTION FOR SECOND TERM TO BE RE
ELECTED FOR THE SECOND TERM
In
order to inculcate the discipline among the workforce it should be ideal to
create the discipline in the representatives of the workforce i.e. the union
leaders, as such it should be made mandatory that all the union office bearers
should present to the duties accurately with minimum attendance in every
quarter with not less than 66% (2/3) of the total working hours of the period
to continue as office bearer; in addition the overall aggregate of 75% of the
days & working hours is necessary for consideration of nomination for re
election for the second term to the union. This method will certainly create
discipline among the union office bearers as well as common workforce.
11.
NEED FOR MANDATORY REPRESENTATION IN ALL ELECTORAL
SYSTEMS FOR THE WORKFORCE FROM MANDAL LEVEL ONWARDS FOR ALL EX UNION LEADER
SHOULD BE THE CRITERIA
Also
it should be ideal that mandatory representation for workforce to get few seats
reserved for them through constitutional amendment to represent their sections
at all levels of governance from the mandal parishad, to the zilla parishad to
the assembly to the parliament either through election or nomination by the
municipal mayor or governor of the state or president of India. This will
certainly ensure that their voices are heard well in the law making.
12.
NEED FOR DECLARATION OF INCOME AND ASSETS OF THE
INDIVIDUAL, FAMILY (PARENTS, BROTHERS& SISTERS, IN-LAWS, SPOUSE, AND
CHILDREN) OF ALL THE UNION MEMBERS AND EX UNION MEMBERS A MANDATORY THROUGH OUT
THEIR LIFE TIME.
Also
it should be made mandatory that in order to ensure fair, honest and sincere
behaviour and practice of non corruption attitude by the union members it
should be made mandatory that the union members should declare the assets of
their individual and their immediate family members (spouse and children) and
also their parents and brothers and sisters in an affidavit form and keep in
the web site. This practice will certainly reduce the collusion of the union
leaders with the managements or also blackmail extortion of the union leaders
from the managements by breaching the trust and confidence kept by the innocent
hard working employees on the union leaders
13.
NEED FOR EXTENSION OF HEALTH CARDS BY THE EMPLOYERS
(BOTH ORGANISED AND UNORGANISED) WHICH ARE TRANSFERABLE FROM ORGANISATION TO
ORGANISATION- DURING THE IDEAL NON WORKING PERIOD GOVERNMENT SHOULD PAY BASED
ON THE DEDUCTION FROM MOBILE PAYMENTS OF ALL MOBILE USERS
Also
it should be made mandatory that all the employers should mandatorily
contribute to the health card of the employee from the management side in
addition to the deduction from the salary amount and crediting in the account
of the employee. In case of the employee shifts the workplace/ organisation the
health card is unchanged and in case of ideal period of the individual the
government will pay for the health care card and soon after joining in the new
work place the new employer start deducting from the salary as well as
contribute from their side also; this is necessary especially for covering the
health care of the unorganised sector
especially the small time employees like the domestic help, drivers,
security guards, watchmen etc. As they change their duties either due to the
change of place of the employers due to transfers etc or by themselves due to
any personal reasons. For this the registration in the government in their
category will help to great extent. People who are working as professional
driver, house made/ domestic help, watchmen, ayas, sweepers etc are low income
unorganised sector. Also they might have migrated from different parts of the
country. Their income is not sufficient to take care of the daily needs, so it
is really a great difficulty for them in case of medical emergencies.
As
majority of the drivers working in passenger transport and goods transport
other than the government and PSU are totally un-organised, does not have
uniform salary, does not have uniform working hours, no health care, and no
track record of the drivers exists, as such in order bring them into some sort
of organised sector with more social security it should be made mandatory that
state RTA should have a special cell to register the private professional
drivers i.e other than the employees of government & PSU. All the drivers
have to register them self with their driving licence, bank account, local
address proof/affidavit (all three are mandatory) in RTA office near the place
of work, all such drivers will be conducted a driving test by the local RTA and
on passing the test will issue a private professional driver licence. Also
there should be uniform fixed salaries throughout the country for all drivers
based on the years of experience, the vehicle type, type of duty i.e public
taxi, private taxi, passenger transport or goods transport etc. All private
employers (other than government) should provide job to registered private
drivers only. To employ a private driver the employer should registration with
the RTA for along with the details of the owner of the vehicle and the details of the local RTA
registration copy of the private driver, then the RTA should issue a permit to
the owner of the vehicle on agreement duly signature by the employer or owner
of the vehicle, and the driver in presence of RTA officials regarding the
minimum salary as per the standard fixed as per the guidelines, salary to be
paid through bank and the number of working hours, number of working days in
month, the mandatory responsibility of the owner for medical check up condition
of driver once in 6 months as pre conditions of employment.
Alternatively
while employing the employer should deposit one month advanced salary with the
government RTA drivers cell and deposit the agreed salary every month to the
RTA drivers cell on the account number of the driver through bank transfer or
bankers cheque only- which in turn will pay the salary to the driver after
deducting the health care amount and debiting some amount in the provision
debit card in case the driver do not come to the duty or irregular the employer
can lode complaint with the RTA cell and it will record such complaints in the
history sheet which will have negative effect on future employment of driver;
also the employer or diver in case wish to leave the employment should provide
at least 15 days notice through RTA drivers cell and in case the driver
absconds without any notice after 3 days the driver should be removed from
employment in case the employer wishes, these kind of measures are a WIN-WIN
for both employee and employer) A copy of the agreement should be forward by
the RTA to the local police for record. It has multiple advantages in the
security angle as well as prevention of accidents, having resting period,
adequate timely salary to cater the family needs; health check up of the
individual is the duty of the employer. It should be applicable not only to the
four wheels and above vehicle drivers but also to the three wheelers if the
three wheel vehicle owners employ the driver to run the vehicle. This facility
will help several lacks of people in the country as majority of the four wheels
have drivers and the three wheel owners are third party. If the vehicle either
four wheeler or three wheeler run on the roads by other than the owner should
be treated as driver. The driver not registered by the owner should be treated
as violation should seize the vehicle with heavy penalty.
Similarly
also there is a need to bring the All the maid servants/ domestic help and
helpers at kirana shops/ small retail propriety outlets who are un–organized to
organised sector in the similar lines of the drivers by registering mandatorily
at the local labour department with a special cell at labour department to
resister the domestic help/servants / small helper with them on the production
of a valid ID proof and bank account to obtain the registration certificate
with a number. All the households/outlets who wish to employ maid servants/
domestic help/helpers should employ only the registered maid servant or
domestic help, by getting the agreement with the special cell of labour
department regarding the place of work, address, the owner, the working time,
number of working hours and the salary, on obtaining the agreement with the
owner the labour department should send the same to the local police for
record. The maid servants are at the
liberty to serve at as many houses as possible based on their stamina after the
fixed working hours of the agreed house is completed. If the work performance
is not satisfied the employer can make a registered remark at the local labour
department special cell and remove them with payment of full salary if they
work for more than 15 days and half salary if they work for more than one week,
less than that only for those days. Also it should be the responsibility of the
employer to deduct 10 % of the salary every month and pay to the insurance
account at the labour department towards the family insurance of the domestic
help. Alternatively the salary agreed should be deposited to the labour
department special cell and it will credit the salary and other payments for
health card etc from the amount deposited as salary by the employer; The
government must contribute equal amount for them to issue health care card for
them, which can be used anywhere in India for themselves and their family
members. This will have multiple advantages, one the security angle, second the
domestic help will get security of the health care, the responsibility of the
individual and government ensures that part of the reduction of burden on the
government. This will certainly cater
the needs of urban poor in the unorganised sector.
Also
like the above all unorganized semi skilled and skilled work force can be
brought to the semi organised work force. This includes the private cobblers,
carpenters, electricians, private plumbers, private vehicle mechanics, gold
smiths, black smiths, tailors etc, who are not working under the government or
PSU (even when they are self employed utilising any government support) should
get registered mandatorily with the labour department of the government, they
should be given registration card after testing them for their basic skills in
their respective profession (the testing of the skills should be recorded in
camera, otherwise there will be a huge chance for mal practice, corruption,
allowing every other individual to get a profession card, in case does not
poses the minimum skills need to be trained), a copy of the registration
details will be sent to the local police for record. Also they should be given
training for a day or two for the skill up gradation/ skill perfection and also
safety measures need in performing their work. Also all these kind of professional service
holders should be given hand held billing machines which are connected through
RFID devices to the government department network to issue the bills on
completion of work, also it should be ideal that government professional labour
cell maintain a call centre and once they receive a call from any individual
house hold or any organisation for repair the computer system automatically
issue the information to the nearest available worker through identifying the
location of the professional service providers through the GPRS and RFID and
makes them to attend the need of the house hold. This will ensure that the person rendering
the services is trained and qualified to officer the professional services.
This will be useful for other than organisations offering such services. Also this method enables that the earnings of
the professionals are recorded and also this enables them to provide the health
care by making them to deposit 10 % of their professional earnings to get the
card and continue as a member of the professional to render services.
Also
it should be ideal that there should be
a mandatory cess of 1 % on the manufacturers of the products related to the
respective professions like all electrical manufacturers like bulbs, chokes,
fans, electric cables etc, and all motor vehicle manufacturers and spare part
manufacturers should mandatorily contribute for the skill development, up
gradation of people in these sectors and also for the government will
contribute from the fund for their social health insurance to all the semi
skilled persons who are not employed in any of the private establishment and
who are either not running any individual private business. As far as the
entire people employed in private establishments it is the responsibility of
the employer to take care of the health of their employees. Also government
should decide the minimum remuneration for the private employees based on the
grading of the skill and experience if they are passed out from any ITI or any
recognised skill training centre, and also for the individual private self
employees the fixed uniform service charge throughout the country. For all
unemployed trained semi skilled labour government should contribute from the
fund collected from the manufacturers related to that profession.
Also
in the similar lines of the above unorganised category, few more categories can
be included to bring more semi skilled people in un organised sector to semi
organized sector. The gold Smiths, black smiths, weavers, cobblers who are
practicing independently, also who are having small establishment under loan
from SC finance corporation, tailors who are practicing independently and all
the weavers in textile looms who owns small looms, etc Also it is ideal to
bring the un organised professionals like qualified priests who has no income
or low income as most religious places are run privately has very meagre
income, qualified teachers/tutors in rural areas and slums not working in any
school etc. Also it will be more ideal to bring all the hawkers selling in the
streets, news paper boys, the milk deliver boys, the street fruits &
vegetable hawkers selling on non motored carts, etc.
Also
this measures of issuing ID cards for the unorganised sector and issue of
health care card will certainly ensure the entire workforce is recorded at
every places from agriculture to different hard working places like working in
the explosive factories, chemical factories, mines etc where large number of
unorganised workforce id dying due to poor health care or due to accidents but
never got reported or adjusted with compensation there and then hushing the
matters, these kind of things will get an end due to the workforce ID card and
health care card for all the workforce of all types in the country.
14.
NEED FOR POLICE VERIFICATION OF CREDENTIALS OF DOMESTIC
HELP/ DRIVERS AND SECURITY GAUDS AND WATCHMEN
Also
it should be made mandatory that the while employing the unorganised sector employees by the
employers it should be mandatory that they will employ only registered
employees otherwise it should lead to criminal offence; also while employing
the registered unorganised employee the
employer must submit the details of employment in the prescribed employment
form with the details of the employee, the working hours the pay agreed, the
minimum duration of contract for employment etc
duly signed / thumb impression of the employee and the contact details,
e- mail and alternative contact details, (in case of house made / domestic help
the details of the employer including the house whether owned or rented, in
case rented rental agreement number, there should be unique rental agreement
number for each agreement; the number of people living in the house etc, in case of driver, the vehicle details, the
cost of the vehicle when purchased, preset value after depreciation, the name
of the owner, the place of stay and the duties and the duty should be only on
the vehicle and place assigned, in case change of duty or on other vehicle the
employer should send the SMS to the government authority dealing with unorganised
sector employees of that nature; this government organisation will immediately/
instantly online send the details to the concerned local police for
verification and to obtain the criminal cases if any pending against the
employee, this will certainly reduce the crimes happing through un organised
employees; also this provides the security for both the employer as well as
employee as the employers credentials are also known to the government so that
watchmen, security, domestic help, drivers , labourer in the factories of un
authorised / non licensed factories etc, also working with the criminals and
epscanders in police cases can be easily identified. This will certainly reduce

real terms. Also this method will certainly track the sales of the traders and

will be able to concentrate more on the work and bring more productive work.

it should be made mandatory that all the employers provide safe drinking water
to their employees; also all organised work places both by the government, PSU
and also by the private establishments more than 100 employees must maintain
the in-house canteen facility or else all the organisations should have tie up
with the caterers to provide hygienic nutritional valued food which was as
suggested by the nutritional experts based on the occupation of the employee as
breakfast/ lunch or as snacks and dinner based on the shift works; this will
certainly provide better health for the employee to provide more better
productive work output as it not only provides health but also reduces work
related stress and more cooperation and coordination among the workforce due to
socialisation and also having the common food from the smallest employee to the
highest employee at the same place and same time period (this measure should be

provide the mobile phone SIM or onetime cost of the set and pay the minimum
monthly bill for all their employees; also similarly to provide tablet PC
(akash or any make) or computer lap top with internet broadband where ever the
service exists and pay the minimum bill to ensure every employee family is net
savy. This will certainly make more and more people are net savy and use the
online facilities for booking bus/ train/ air tickets, also enables them to pay

working condition from the appropriate light with minimum lux in the working
area to fresh air to the, the green building to the safe drinking water to the
provision of hygienic toilets etc should be provided. Also the working tables
and chairs should be ergonomically designed to reduce the stress & strain
and fatigue, Also it should be made mandatory that all organisations should
provide ILO standards for better working conditions to reduce the stress and
fatigue in the workers by providing the work breaks/ rest periods during the
working hours; also all the organisations should provide appropriate space
either in the premises or very near vicinity in a group of organisations the recreation either in-door or outdoor
games and fresh oxygen facility (oxygen bars in case of highly polluted
industries). Also should provide appropriate conveyance to reach the work
place.

it should be made mandatory that the unions in the individual factory or the
unions in the ward/ village are responsible for the emissions of excess
untreated gases and effluents in the open air / land by the factories
contaminating the air/ water/ land through pollution. This method will
certainly provide positive results, as the unions should complaint to the
pollution control board, else should be treated as hand in glove with the
managements. And the same criminal cases that are applicable to the managements
should be applicable to the workers union leaders/ office bearers, this measure
will certainly reduce the pollution related issues. Also similarly for
spurious/ adulterated products or excess production and zero tax sales etc the
unions in the manufacturing uint should take the responsibility.

rent etc for the offices of the unions in the wards / villages to enable them
to have some office facility.

NEED FOR RESTRICTION OF WORKFORCE UNIONS RIGHT TO
STRIKE ONLY FOR THE ISSUES PERTAINING TO THE EMPLOYMENT THAT TOO AS LAST RESORT AND ONLY PROTEST
SHOULD BE ALLOWED, BANNING WORKFORCE UNIONS TO EXTEND SUPPORT/ PARTICIPATION ON
SOCIAL & OTHER ECONOMIC ISSUES

it should be made mandatory that all the workforce unions are restricted their
right to strike for the issues related their employment in that region/ arena
focusing only on their occupation/ profession only; they are completely barred
from supporting any strikes or moments organised by some other workforce union
or other NGO’s or any political party for any socio-economic issues. This will

acquisition in the gram sabhas in these villages and approval of 4/5 of the
majority within the gram sabha and overall 2/3 majority of the gram sabhas in
the mandal and in addition 3/4 of the mandals approval within the stipulated area
intended to acquire. This process of getting the peoples approval should be
completed in 3 months by conducting public meetings under video recording and
with voting; the government must charge the processing fees from the companies
for using its machinery for acquiring the land. Also to protect the interest of
the both buyers and sellers government must fix the minimum and maximum sale
price.
Also
in case of purely private acquisition in case ¾
of the land holders or ¾ of the total land required for the proposed
project is acquired by the private party with minimum maximum value of the
property, then the remaining land should be registered to the private party at
the maximum value permitted by the concerned registration authority; this
registration should be permitted only on registering the ¾ of the land by the
private developer on full payment to the 3/4 of the land to the concerned
landowners. Otherwise the investments attraction for the development of
properties is not possible and due to the jack up of the prices or due to non
sale of the part left over most of the developers approaching high clout
political and anti social elements for acquiring the property for the projects
which case the land owners are losing and the middle men are gaining and the
project developers are gaining, the proposed methods are certainly a WIN-WIN
for both the land owners as well the project developers.

it should be made mandatory in order to protect the interest of the land owners
being exploited by the middlemen/ local politicians/ real estate mafias and the
corporate by taking them at very peanut price and selling at pumpkin price to

FACTORY RUNNING IN PROFITS OR LOSSES TO THE FAMILY OF THE LAND OWNER FAMILY.

the government must provide jobs to the locals and monthly compensation for the
locals who lost their land in land acquisition for the purpose of project
construction; in addition government must re habilitate them and also
government must protect the interest of the people living in that area who do
not hold land like fishermen etc by paying not only one time compensation, but
also monthly pension for them as they do not know other than their profession
to earn their lively hood.

NEED FOR MANDATORY SHARE OF PROFITS BY THE MANAGEMENTS
TO THE EMPLOYEES; THE MINIMUM PROFIT SHARE SHOULD BE 10% OF THE TOTAL PROFIT
BEFORE TAX TO ENSURE INCLUSIVE GROWTH OF BOTH EMPLOYEES AND EMPLOYER

it should be made mandatory that all organisations from kirana shop / pan shop
to a giant industrial establishment must share part of their profit to the
employees; the share of profit should be minimum 10% of their total profit
before tax. This will certainly make better living for all the employees and is
certainly a recognisation for the hard work and because of the hardship of
employees the organisations are getting profits apart from their capital
investment, as in most of the instances the capital is drawn from banks and
other financial institutions. The payment to the employees should be made

“POWER OF SUB CONSCIOUS MIND” TO ALL WORKFORCE.
Also it should be
made mandatory that all the government in association with banks and financial
institutions should ensure that all the entire workforce both organised and un
organised should be provided with the financial management, financial
counselling for proper utilisation of the limited resources, enhancing it in
legitimate safe manner (alert / awareness before investment in any institutions
other than government and established banking systems), encouraging in savings
for the future, also ensuring they are out of the existing financial crunch in
some people. Also ensuring that every single workforce will possess the bank
account, also training the educated
workforce in using the mobile/internet banking and use of online payment and online
banking transactions for payment of utility bills, for booking railway tickets
etc. These measures are necessary as the workforce is mostly got cheated by the
so called “money circulation schemes”, the chit funds etc in the pretext of
higher interest and faster multiplication of money; as such all these
un-organised and organised workforce should be thought about the awareness
ensuring their hard earned money is not siphoned by the cheaters; also it will
certainly reduce the wastage of money spending on the so called “babas, mullas,
fakers etc” making them to spend money in the pretext of getting extra money/
resolving their financial crises making these already stressed small earners
with more financial and mental burden, hardly there are noticeable change
through such process; Also it should be

life by achieving their wishes.

CONCLUSION
Since
there is an abnormal growth of the unorganised sector of employment and also
surprisingly the abnormal increase of contract workers instead of permanent
workers in the private as well as government establishments there is urgent
need for correction in the system, Also
there is an abnormal rise of growth of income/ profit margin of the employers/
organisation but the growth of income and living standards of the employees are
being deteriorated and the living standards are being in steep decline and the
health issues are alarmingly on the rise and which may lead to loss of
production hampering overall economic growth of the country and thus the
standards of living of the people in the country; as such there should a
systemic correction in channelling both unorganised workforce as well as
organised workforce is required in order to ensure that the first and foremost
thing is to make it mandatory that the government must form an agency to register
the individual according the nature of skill/ work he/she intended to perform,
un skilled, semi skilled or skilled based on the respective strengths and
training in each and every category of work; also to ensure that every un
organised and organised workforce should be provided with bank account then to
issue the registration number with ID card; all the employees must be provide
employment only based the registration number; this will also provide the
details of previous employment, also verification of credentials for unskilled
workers in the domestic areas, also this methods has many advantages of its
own; like all the payments to the employees are mandatorily recorded, also it
enables the health care card provision for all employees of what so ever nature;
also it should be made mandatory to provide the “provisions debit card” by
deducting the 25 % of the salary amount of each employee (any one member in the
house hold) in the organised sector and contract workers to ensure the
employees mandatorily use 25 % of salary for the food only to ensure at least
the families of the employees should have health food; also making it mandatory
that all employers must provide balanced diet food for the employees during the
working period in their premises or for the organisation; also making it
mandatory that providing the education for the children of the employees is the
responsibility of the employer, also it should be made mandatory that all the
organised sector employees and contract employees in the organised sector and
semi organised sector (other than labour) should be provided with tablet PC and
basic mobile charge as well as basic internet charges ensuring that all the
employees are fully conned with the communication and enabling them to use the
online payments for the statutory payments like electricity bill, other bills,
booking of travel tickets etc which will certainly reduce the burden on the
travel organisations as well as recording of the legitimacy of the travel;
